Last year, we thought that the Fan that is taking Sony, The Estate and the Cascios in court regarding the 3 fake songs on the posthumous album “MICHAEL”, Vera Serova was losing the case.
But yesterday, Attorney General Becerra asked the state Supreme Court to reject Sony’s interpretation of the First Amendment related to false advertising.
Sony’s overly broad interpretation of the First Amendment fails to protect consumers by enabling companies from a wide array of industries to make false or misleading claims about their products and then declare ignorance of the misrepresentation.
Meaning that Sony might be held responsible for the 3 fake songs along with the Estate and the Cascios while last year, Sony was pretty much out of the law suite claiming they were not responsible for the fake songs as they did not record them.
